WH-516 and WH-521

The U.S. Dept of Labor, Wage and Hour Division, has published updated forms WH-516 and WH-521. Both forms had previously had an expiration date of 06/30/17 and that has been extended only 30 days to 07/31/17.

'WH-516 Worker Information - Terms and Conditions of Employment' is the form where you disclose the period of employment and rates of pay, along with other information to your migrant and seasonal workers. It is required to be provided to migrant workers at the time of recruitment and seasonal workers upon request. Since you may not always know who is migrant and/or seasonal, it is recommended that you provide the WH-516 to all seasonal and migrant workers at the time of recruitment. This form is also required to be provided to all H-2A foreign workers.

Begin using this latest version of the form starting July 1, 2017 (You don't have to reissue it to those workers who you have already provided the form to). The updated form is scheduled to expire at the end of July, so you will need to update again at month end. 

The latest version of the WH-516 form may be downloaded at: https://www.dol.gov/whd/forms/index.htm (You will need to download both English and Spanish).

'WH-521 Housing Terms and Conditions' is the form where you disclose who is providing the housing, contact information, and conditions of occupancy. It is in both English and Spanish and is provided to all Migrant and Seasonal workers who occupy employer provided housing.

Begin using this latest version of the form starting July 1, 2017 (You don't have to reissue it to those workers who you have already provided the form to). The updated form is scheduled to expire at the end of July, so you will need to update again at month end.
