Complaint Filed Against Attorney General for Survey Investigation
Politically motivated investigation must end
On June 22, wafla filed a complaint in Douglas County Superior Court requesting that the Court end the Attorney General's (AG) civil investigation of wafla, and award damages and attorney fees. To view the full complaint, click here.

The AG began an investigation of wafla in late 2015. The reason for the investigation was advice that wafla publicly gave members regarding a 2015 agriculture wage and practices survey conducted by the Employment Security Department (ESD). During the course of the investigation, ESD conceded that wafla's advice was legally correct, and the agency altered its Wage and Practices Survey the next year to incorporate wafla's suggested revisions.

Wafla initially cooperated with the investigation, and turned over more than 120,000 pages of documents to the AG. In December 2016, Douglas County Superior Court Judge John Hotchkiss ruled that a civil investigative demand issued by the AG was legally and constitutionally defective.  You can review the full court ruling here.  The AG did not appeal the Court's ruling. The AG has refused several requests by wafla to close the investigation.

Farmers rely on wafla to vigorously monitor government actions, and point out problems when they arise. That is what we did, and we commend ESD for making the necessary changes to their annual survey. It is time to end this politically motivated investigation and move on.

Wafla looks forward to working cooperatively with the AG to settle its claims and close the investigation.
